What Information We Collect
We collect two types of information:
- Personally Identifiable Information (PII), which consists of any information that can be used to specifically identify you as an individual, and
- Non-Personally Identifiable Information (non-PII), which consists of aggregate information that does not reveal your identity.
The following sections describe how your PII and non-PII are collected by us, and how we use such information.
How We Collect and Use Information
We use the information we collect from you to deliver Services to you and to continuously enhance your user experience. Generally speaking, we use the collected information to communicate with you, fulfill your requests, customize the content, improve our products and services, protect both your rights and ours, and comply with all applicable laws and regulations.

Any time you visit the Site, our servers automatically gather information from your browser (such as your IP addresses, browser type, Internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks). This information may be used to analyze trends, administer the site, prevent fraud, track visitor movement in the aggregate, and gather broad demographic information. We do not share this information externally.

Community Rewards encourages users to complete challenges, to accumulate points, and earn rewards.
You can join and play the App through your Facebook, Google, or Twitter user account(s) which will request certain data that can be managed in your privacy settings on Facebook and Google.

If from Facebook:
- Your basic info (Name, profile picture, gender, age range, user ID, and any other information you made public)
- Your e-mail address
- Your likes
If from Google:
- Know your basic info (Your name, profile picture, Google+ ID, age range, and language.)
- A list of people you've connected to on Google+
- Any other publicly available information on your Google+ profile.
- Your email address
If from Twitter:
- Know your basic info (Your name and profile picture).
- Your email address

When you go to this application, or connect with our website using Facebook, Google, or Twitter (sometimes referred to as just “Application(s)” or “Apps”), Modern Message will receive your email address and your App IDs.
Your Application account IDs help our App personalize your experience because it can connect your account on that App with your Facebook and/or Google account, and it can access your public information. This includes the information you choose to make public, as well as information that is always publicly available. If the App needs any additional information, the App will ask you for your permission.
This App allows you control the application you use. You can see the permissions you have given these Apps, as well as the last time an App accessed your information. You can also remove this App if you no longer want. When you remove or uninstall all Apps, your User ID is no longer given to the Apps, even when your friends use those Apps. But, you will no longer be able to use this App or Site through Facebook and/or Google.
Information About You
When you install the App, we collect a variety of information about you to complete your online profile. Except as otherwise stated in this privacy statement, we do not disclose your PII to other users of the Services. If you choose to connect your Modern Message account with Facebook, Google, or any other service, we will receive and retain basic account registration data you provide to that service, such as name, email address, user ID and profile page URL. We may also receive and display content relevant to your use of the Services from activity feeds or other information from Facebook, Google, and other linked services, including the contents of your page news feed, posts” status updates, comments, photos, +1’s, reviews, and location “check-ins” to the extent you grant us access to such information from those services.
We require an email address from you when you register for the Services. We use your email for both transactional (e.g., activity updates such as notices that you have earned a prize through the Services) and promotional (e.g., newsletters, new product offerings, event notifications, new action items) purposes. Email messages we send you may contain code that enables our database to track your usage of the emails, including whether the email was opened and what links (if any) were clicked. If you would rather not receive emails from us, please see the section below labeled “Choice/Opt-Out”. We may also contact you by text message (including to any wireless number you may provide to us) solely in connection with the Services. If you would rather not receive text messages from us, you may change or delete your number from your “Account Settings” page, or ask to be removed from our contact list if you receive a call or text message from us. We fully comply with the requirements of the U.S. CAN-SPAM Act.
Online Survey Data
We may periodically conduct voluntary member surveys. We encourage our members to participate in such surveys because they provide us with important information regarding the improvement of the Service. You may also volunteer for certain surveys that we may offer to our users, and any additional rules regarding the conduct of such surveys will be disclosed to you prior to your participation. We do not link the survey responses to any PII, and all responses are anonymous.
Information Regarding Your Friends
We may offer contact importer tools to help you upload your friends' addresses so that you can find your friends on the Site, and invite your contacts who do not have Modern Message accounts to join. You have full control to determine who of your designated contacts will receive one or more email messages containing your name and inviting them to visit the Site, which may include follow-up or reminder messages. These emails will also include instructions on how to remove their information from our database.
Fees and Services
Disclosure of Your Information to Third Parties
- Disclosure by Law:
You acknowledge and agree that we may disclose information you provide if required to do so by law, at the request of a third party, or if we, in our sole discretion, believe that disclosure is reasonable to (1) comply with the law, requests or orders from law enforcement, or any legal process (whether or not such disclosure is required by applicable law); (2) protect or defend the rights or property of Modern Message or a third party; or (3) protect someone's health or safety.
- Disclosure to Trusted Third Parties By Us:
We may share your non-PII with third parties, but not in a manner that would reveal your identity. We may share your PII, sometimes in conjunction with your non-PII, with service providers that may be associated with us to perform functions on our behalf. For example, outsourced customer support agents or technology infrastructure providers may need access to your information to perform services for you. Your information will be treated as private and confidential by such service providers and not used for any other purpose than we authorize. In addition, from time to time, we may share PII (such as email or mailing address) about our user base with carefully selected third parties, so they can offer goods and services that we believe may be of interest to our users. If you do not wish to receive offers from our trusted partners, you can change your email preferences at any time by following the steps outlined in the “Choice/Opt-Out” section below.
- Information Transferred As a Result of Sale of Business:
As we develop our business, we may buy or sell assets and, depending on the transaction, your PII may be one of the transferred assets. In the event that we are acquired by another company, your PII may be part of the assets transferred to the acquiring party. If this occurs, you will be notified if there are any material changes to the way your PII is collected or used.
We may use third-party advertising agencies or other service providers to serve ads on the Site on behalf of Modern Message or third-party advertisers (e.g., retailers of goods or services). These companies may employ cookies and web beacons to measure advertising effectiveness. Any information that these third parties collect via cookies and web beacons is completely anonymous. Some of these third-party advertising agencies may be members of the Network Advertising Initiative, which offers you the option to opt out of ad targeting from its member agencies by following the procedures listed here. We will only share your information with third parties in the ways defined in this privacy statement.
Our age restrictions for the Service are set forth in the Terms of Service Agreement. We do not target our Site or Service to minors under the age of 13, and in compliance with the Children's Online Privacy Protection Act, any information we may receive from users we believe to be under the age of 13 will be purged from our database
Our services are intended for use only by United States and Canadian residents at this time. If you reside outside the United States or Canada, you access the website at your own risk and any rewards earned may not be redeemable. Users may not access the site, register for or use the services if prohibited by law in their country of residence.
We have security measures in place to protect the loss, misuse and alteration of the information stored in our database. We will exercise reasonable care in providing secure transmission of information between your computer and our servers, but given that we cannot ensure or warrant the security of any information transmitted to us over the Internet, we accept no liability for any unintentional disclosure.

We are not responsible for the privacy practices or the content of other websites that may be linked to this Site or of any third party advertisers.
You may use the following options for removing your information from our email database if you wish to opt out of receiving promotional emails and newsletters. * Click on the “unsubscribe” link on the bottom of the email; or you many uninstall the Community Rewards Facebook application from your Facebook account.
Updating Your Information
You may change your email address, password and other information from the “Account Settings” page accessible via a link from the Site home page. To the extent you choose to include PII or other information in your profile, the Service allows you to update or remove that information by editing or deleting the content.
